No, unfortunately they're not good at all, and unless you go for a used one, no flute you get in that price range will be even decent. They're among the junkers that have been hitting the market recently, which are made of pot metal, so they're easier to damage and harder to fix (most techs won't even look at them), and most have a horrendous scale (some notes are naturally 1/4 step or more sharp or flat), as well as highly unreliable mechanisms, and mediocre (at best) headjoints. I would not suggest you get a Victory or any other off-brand flute. As a general rule, if you do a search on the company name, a professional looking website should come up among the first few hits. If you only come up with retailers distributing them, or vague mentions of the name, pass the flute up. Also avoid colored flutes like those often seen on eBay, those with multiple identical listings, or any that just seem to cheap to be true (like this Victory).

Well, do you have another that you can play, or can you return it to the store? If you can return it for a refund, that would be best. It's likely that Victory will fall apart in just a few months if you were to play it. If not, I'm afraid they've wasted their money, and hopefully you have a better quality instrument to play. If not, you'll need to look into purchasing a different flute from a reputable maker.

So it's a piccolo you have, not a flute? In either case, it most likely will not work for very long, and will be very difficult to get repaired (if you can manage that at all). If you want a piccolo, you can get a used student model (in playing condition) from Armstrong or a similar maker for just a couple hundred dollars, and that would be a much better investment. Feel free to try that piccolo out, but I would not suggest keeping it, and doing so might ruin any possibility you have to return it.

<Added>

That last sentence of mine was a bit unclear. Trying out the piccolo may negate its returnability.

When she bought it the thing said that it has a 5 year warrenty.... If they say that then if it breaks can i still return it and get my money back... What does that mean exactly

It means that they guarantee that it will work, or they'll give you something in compensation (usually repairs, money, or the like). Most likely you'll have to send it back to the factory (probably somewhere in China), and they'll be required to either fix or replace the parts that have caused the issue, or perhaps refund you the cost (probably minus shipping, insurance, sales tax, etc.). It's great to have a warranty, but on something so shoddily produced as most of these junker instruments, it will likely spend more time at the factory/repair tech than in your hands.

Assuming they honor the warranty, then if a refund is an option, yes you could return it for a refund if it breaks, but most of the time, they'll simply opt to fix or replace it.

There's no way to be sure, but it's not unusual for the producers of these instruments to be...Misleading. They constantly change the names that are engraved on the instruments whenever one name gets too bad a reputation. In fact, they'll sell blanks (instruments without names) to anyone, and let them engrave whatever they want on there, and then sell it to the public. Most of these flutes are from China, others are from Pakistan, but it's almost impossible to know for sure where any specific make of junker came from. Keep in mind that a low quality instrument will most likely not give you a good impression of what the piccolo is actually like. There are some very fine quality piccolos available, and with experience, a player can make a good quality picc do anything a flute can do, so don't get too frustrated if this picc doesn't allow you to play like you want to.

Should you choose to keep this instrument, you'll more than likely need a new one within a year (most breakdown after just a few months), so be prepared for that eventuality. It would make more sense financially to return it now and buy a better quality instrument, but if that's not possible/you choose not to, you should realize that this is only likely to be useful in the VERY short term.
